Terms of Service

These Terms of Service ("Terms") govern your use of the Nyvo app and website (the "Service"). By creating an account or using the Service you agree to these Terms. The Service is operated by Nyvo Pty Ltd, a company registered in Australia.
Eligibility
You must be at least 16 years old to use Nyvo. By signing up you confirm that you meet this requirement and that all information you provide is accurate.
Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us at security@nyvo.com.au immediately if you suspect unauthorised access.
Acceptable use
The community is built on respect. You agree not to:
- Post or share content that is unlawful, hateful, harassing, defamatory, sexually explicit, or violent.
- Impersonate another person or organisation.
- Spam, scrape, or use automated tools to interact with the Service.
- Attempt to bypass rate limits, security controls, or content moderation.
- Use the Service to violate any Australian or international law, including the Privacy Act 1988 (Cth) and applicable anti-discrimination legislation.
We may remove content, suspend, or terminate accounts that violate these rules at our sole discretion.
Content moderation
User-generated content (posts, comments, businesses, events, listings, reviews) is moderated by community leaders, our moderation team, and automated systems including Google Cloud Vision SafeSearch for image safety. Content that fails moderation is hidden or removed and the author is notified by email and push.
Your content
You retain ownership of the content you post on Nyvo. By posting, you grant Nyvo a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting), distribute, translate, and display the content within the Service for as long as your account exists.
You are solely responsible for the content you post. Nyvo is not liable for content posted by other users.
Paid features
Some features (event tickets, premium business listings) are paid. Payment is processed by Stripe. Refunds for cancelled events are issued to the original payment method within 5–10 business days. Refunds outside this scenario are at our discretion and consistent with the Australian Consumer Law.
Third-party services
The Service relies on third-party providers including Firebase, Stripe, Resend, Vercel, Google Cloud Vision, and Google Maps. Their terms apply to the portions of the Service they power. See our Privacy Policy for details.
Termination
You may delete your account at any time from Settings → Delete account. We may suspend or terminate your account if you violate these Terms or applicable law. On termination your access to the Service ends and your data is deleted in accordance with our Privacy Policy.
Disclaimers
The Service is provided "as is" without warranties of any kind, except for those guaranteed by the Australian Consumer Law. To the maximum extent permitted by law, Nyvo disclaims liability for indirect, incidental, or consequential damages arising from your use of the Service.
Governing law and jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria. The Service is operated under the Australian Privacy Act 1988 (Cth).
Changes to these terms
We may update these Terms as the Service evolves. We will notify you in-app and by email at least 14 days before any material change takes effect. Continuing to use the Service after the change date means you accept the updated Terms.
